כיצד מתנהלים שני משפטים במקביל?

עורך דין פלילי שרון נהרי מציין כי במקרה בו נגד נאשם אחד מתנהלים שני משפטים במקביל, יש לבחון כל תיק בפני עצמו. עם זאת, יכול להיות מצב שבמשפט אחד יש לנהל הוכחות ואז יהיה מומלץ לבחון את המשפט השני, לבדוק באיזו עבירה הוא עוסק וכיצד הסדר בתיק הזה, יכול להשפיע במקרה של הרשעה בתיק הנוסף.
איחוד שני משפטים: הקלה בעונש או החמרתו?
אם נאשם מודה בשני המשפטים, המצב טוב יותר עבורו ואף ניתן לאחד את התיקים יחד ולבחון ענישה אחת על שתי העבירות. מצב זה בדרך כלל מקל יותר מאשר הרשעה בתיק אחד עם עונש, ואחר כך שוב ענישה בתיק אחר. במצב בו התיקים לא מאוחדים צריך לבחון כיצד ענישה בתיק אחד משפיעה על מצבו המשפטי בתיק אחר.
במקרה זה כבוד השופטת לימור מרגולין-יחידי ניהלה את התיק וגזרה על הנאשם עונש של 30 חודשי מאסר. בפסק הדין הסבירה מרגולין-יחידי כי היא מתייחסת בחומרה לעבירות בתחום החשבוניות הפיקטיביות, משום שהן הפכו לתופעה נפוצה שקשה לעצור אותה. בנוסף לכך היא הדגישה כי בעניינו של הנאשם הספציפי היא מחמירה אף יותר בעונש, שכן הוא ביצע עבירות אלו שוב לאחר שעומד לדין על עבירות זהות קודמות.
